hi bit of a noddy question but does anyone know if i can take a passenger in the back of my 280sl without a seat belt?

I think the law is... if seatbelts are fitted, they have to be worn
But if seatbelts are not fitted, the passenger can ride without them
at least according to this

Does this still apply if one does'nt have a kinder seat (3rd seat) and the passenger squats on the parcel shelf?

No, I think there's a problem with passengers who are not "in a seat"
IIRC it's technically illegal to ride in the back of a van, for example.
Kinder seat is a seat - albeit for those of smaller proportions, and therefore you're fine sitting with no seat belt
